TERMS & CONDITIONS

1. Acceptance of Terms

By signing the sales order or submitting an order via phone, email, or through our web store, you acknowledge and agree to all terms and conditions outlined below. These terms constitute a legally binding contract between the customer (“Customer”) and Lowcountry Block, LLC, DBA Lowcountry Paver (“Company”).

2. Payment Policy

2.1 General Terms
    • All orders, prices, specifications, and conditions are deemed satisfactory and accepted upon order confirmation.
    • Customers with approved credit terms must pay all balances within thirty (30) days from the delivery date.
    • A finance charge of 4% per month (48% annually) will be applied to overdue accounts exceeding thirty-one (31) days past the delivery date, with a minimum charge of $2.00 per month.
    • The Customer agrees to pay all attorney and collection fees incurred to recover outstanding balances.
    • All disputes shall be resolved exclusively in the Jasper County, SC court system.
2.2 C.O.D. Terms
    • Any account with an unpaid invoice exceeding thirty (30) days will be placed on C.O.D. (Cash on Delivery) until the balance is fully paid.
    • Any account with an invoice over ninety (90) days will remain on C.O.D. for a minimum of twelve (12) months before reconsideration for credit terms.
    • C.O.D. customers must pay in full prior to delivery.
    • If an account balance exceeds sixty (60) days, a lien will be filed, and the purchaser is responsible for all legal and collection fees.
    • The Customer agrees to be held corporately and personally responsible for all products purchased on their account, including fees and accrued interest.

3. Orders & Holding Policy

3.1 Signed Purchase Orders & Email Confirmation
    • A signed purchase order or an email order is a legally binding contract.
    • Orders containing non-stock or special-order products are non-cancelable and must be paid in full.
    • Stock product orders canceled or not picked up will incur a 25% restocking fee.
3.2 Holding Orders
    • Material will be held for a maximum of two (2) weeks after receiving a signed purchase order.
    • If not picked up within two (2) weeks, the product will be restocked and a 25% restocking fee will be charged.
    • Custom orders will be held at no charge for up to four (4) weeks. After that, a charge of $5 per pallet, per week will be added to the invoice.

4. Return Policy

  • No returns accepted after thirty (30) days from the delivery date.
  • Non-stock, special-order, partial, opened, mixed pallets, and second-quality material are non-returnable.
  • Only first-quality, stocked product in factory-wrapped cubes (60mm, 80mm) can be returned, with a 25% restocking fee.
  • Installed product is not returnable except for structurally defective materials.
  • Delivery fees are non-refundable.
  • Customers must return materials to Hardeeville, SC at their own expense.
  • Refunds are issued as account credit only; no cash refunds are provided if an outstanding balance exists.

5. Delivery Policy

  • Fuel surcharges apply when fuel prices exceed our estimated cost and may fluctuate without notice.
  • Delivery includes 45 minutes of unloading time. Excess unloading time incurs a fee of $45 per half hour.
  • Curbside delivery is the only guaranteed placement. Any special placement requests are at the customer’s risk, and the Company is not responsible for damages to property, including lawns, irrigation systems, and driveways.
  • If no representative is on-site, the Company is not responsible for incorrect product placement.
  • Incorrect deliveries will be redelivered as soon as possible; however, no compensation is given for delays.

6. Product Responsibility & Pickup Policy

  • Customers are responsible for any vehicle damage incurred during pickup at our facility.
  • Products are loaded via forklift and may weigh up to 4,500 lbs.

7. Pallet Return Program

  • Customers receive a $7.50 credit per undamaged, reusable pallet returned to Lowcountry Paver.
  • If pallets are picked up by the Company, credit will be issued minus the pickup fee.
  • Credit is applied to the account; no cash refunds.

8. Product Characteristics & Color Matching

  • Blends include some solid colors. Customers should review samples with installers.
  • Colors vary by batch; samples are representations only and not guaranteed matches.
  • Installed product is not refundable due to color variations.
  • Efflorescence is a natural occurrence and not covered under warranty.
  • Best color consistency is achieved by blending pavers from multiple pallets during installation.

9. Warranty & Defective Materials

  • The Company offers a non-transferable, 20-year structural integrity guarantee to the original purchaser.
  • Defective material will be replaced as per our guarantee. The Company will cover up to $2.00 per sq. ft. to remove and replace defective material.
  • Products must be installed per CPI installation guidelines to qualify for warranty coverage.
  • 30mm products are not warrantied for vehicular applications.
  • 60mm pavers are warrantied for residential driveways only.
  • 80mm pavers (excluding Turf-Block & Subway Stone) are warrantied for all vehicular applications.

10. Dispute Resolution & Mediation

  • Any dispute will first be resolved through informal negotiations within thirty (30) days.
  • If unresolved, disputes will proceed to mediation in Hardeeville, SC.
  • If mediation fails within 30 days, litigation may proceed in South Carolina courts.

11. Product-Specific Return Policies

11.1 Lowcountry Turf
    • Cut turf is non-returnable.
    • Full rolls of uncut turf may be returned in original condition.
    • Defective turf must be reported before installation.
11.2 In-Lite Products
    • Returnable only if unused and in original packaging.
    • Installation issues must be promptly reported for inspection.
11.3 SEK SUREBOND
    • Returnable only if unopened and unused.
    • Issues must be promptly reported for inspection.

12. Acknowledgment & Agreement

By placing an order, the Customer acknowledges and agrees to these Terms & Conditions. The Customer is responsible for ensuring all installation and warranty guidelines are followed to qualify for returns, exchanges, or warranty claims.
